Sr. Counsel - Oncology Practice Management

Location: Dallas or The Woodlands, TX; Atlanta, GA; Columbus, OH; Richmond, VA; Washington, DC

Unique opportunity to join McKesson’s General Counsel Organization (GCO) as a senior attorney focusing primarily on McKesson’s oncology physician practice management business, The US Oncology Network (The Network). The Network is a collection of more than 45 physician practices with more than 1,400 physicians who care for an estimated 15% of the patients diagnosed with cancer in the United States each year. The Network practice management team is part of the Pharmaceutical Solutions and Services division of McKesson, the company’s largest division.

The successful candidate will become a critical member of a collegial and highly experienced team responsible for managing all legal aspects of this practice management business.

Current Need:
The McKesson GCO is seeking an experienced healthcare attorney to join the legal team supporting The US Oncology Network. This position will report to the Assistant General Counsel leading the legal team supporting The Network, with primary responsibilities expected to be supporting the operations teams that are responsible for the day-to-day management of all business aspects of the oncology practices in The Network, the business development team that seeks to add new practices and physicians to The Network, and the procurement team that secures and manages contracts with vendors for the services and products used by practices in The Network.

Primary Responsibilities:
• Provides routine day-to-day legal support for the practice management business, which can cover a broad range of legal issues arising in a complex healthcare business
• Provides health care regulatory advice (AKS, Stark Law, FCA, CMS and state rules and regulations) related to arrangements with physician practices
• Works collaboratively with the business development and operations teams on their efforts to grow The Network and improve the performance of the practices in The Network
• Drafts, reviews and negotiates agreements related to the practice management business
• Advises on structure, performs due diligence, and draft, reviews and negotiates letters of intent, term sheets and definitive transaction agreements to add additional physician practices to The Network and to add additional physicians to practices already in The Network, including long-term management services agreements, asset purchase agreements and joint venture agreements with physicians, hospitals and other healthcare providers
• Coordinates with other attorneys and legal specialists in the McKesson GCO supporting The Network
• Coordinates with other attorneys in the McKesson General Counsel Organization on litigation, labor and employment, IP and other matters arising in The Network
• Frequent interactions with other internal stakeholders across functional groups

Qualifications:
• Minimum Requirements 7+ years of relevant legal experience in a corporate legal department or law firm providing legal counsel to health care provider clients
• Familiarity with fraud and abuse and other healthcare laws, transactions, and contract negotiations

Critical Skills:
• Must be a team player who can develop strong working relationships and work collaboratively with many business leaders from multiple functions and with other members of the legal team
• Excellent interpersonal skills with an ability to provide sound, clear legal advice and to earn the trust and confidence of the business
• Excellent transaction and commercial contract drafting and negotiation skills
• Knowledge of payer, regulatory, compliance, privacy and licensure issues at the federal and state level relative to physician practices
• Outstanding verbal and written communication skills and attention to detail
• Strong business acumen dealing with high-stakes negotiations, risk analysis and organizational priorities
• Flexibility and willingness to work on a broad variety of legal matters
• Ability to work under pressure and manage multiple projects in an efficient and timely manner
• Proactive problem-solving approach

Education:
• Juris Doctor Degree with excellent academic credentials
• Member of a state bar in good standing

Our Base Pay Range for this position

$128,900 - $214,900
