Senior Counsel - Medical-Surgical Extended Care

Location: Richmond, VA

Summary: As a valued member of the General Counsel Organization (GCO), the Senior Counsel will serve in a supervisory role for many legal matters within McKesson’s Medical-Surgical business unit and sub-business units, providing day-to-day counseling and issue identification. This position will provide counsel to McKesson Medical-Surgical’s Extended Care customer business, including the Biomedical Solutions business. The Senior Counsel will frequently engage with other internal legal, compliance, and business stakeholders across functional groups, as well as specialized outside counsel. The Senior Counsel will work with members of the GCO to provide support drafting, reviewing, analyzing, and negotiating contracts with escalation to the supervising attorney as necessary. Agreement types may include, without limitation, customer product supply agreements, discount and rebate agreements, and rental and service agreements. The Senior Counsel will be an essential resource for the Biomedical Solutions team in support of projects and new business initiatives. This role requires the ability to work independently and assess when to seek guidance of supervising attorneys. The attorney hired to fill this Senior Counsel role must be an independent, business-minded, healthcare-focused, transactional, and regulatory attorney who will serve as a highly visible point of contact for a wide array of legal and business matters. Reporting to the Managing Chief Counsel and working directly with the business team, the Senior Counsel shall possess exceptional professional judgment and be able to provide decisive day-to-day legal counseling and advice to all levels of the organization.

Primary Responsibilities:
• Provision of legal contracting support by overseeing drafting, providing review and analysis, and negotiating contracts with escalation to the supervising attorney as necessary
• Consulting on legal and business provisions in contracts, coordinating contract approvals and advising on contract enforcement issues as needed
• Providing health care regulatory advice (FDA, AKS, FCA, Stark, Privacy regulations, CMS and state rules and regulations) related to commercial arrangements with healthcare manufacturers and providers and identify regulatory issues, assess business impact risk and communicate same to business partners
• Recommend and implement contracting policies, procedures and processes
• Be a team player who can cultivate strong working relationships and who can work collaboratively with internal clients and other members of the legal team
• Identifying and analyzing risk, determining the level of risk and required escalations appropriately
• Demonstrating comprehensive understanding of McKesson business units, products, strategy, and operational model
• Frequent interactions with other internal legal, business, and operations stakeholders across functional groups and business segments
• Work under supervision of supervising attorneys and exercise independent judgment in escalating issues as appropriate within broadly defined practices and policies.

Critical Requirements:
• Must be a team player who can develop strong working relationships and work collaboratively with many business leaders from multiple functions and with other members of the legal team
• Excellent interpersonal skills with an ability to provide sound, clear legal advice and to earn the trust and confidence of the business
• Excellent commercial contract drafting and negotiation skills
• Knowledge and understanding of healthcare fraud and abuse laws
• Ability to adapt communication style depending on the recipient’s level of sophistication about legal issue
• Comfortable working on multiple projects concurrently
• Business acumen dealing with risk management and organizational savvy

Organizational and project management skills

Qualifications:
• Juris Doctorate and bar licensure in at least one state is required
• Minimum Requirements: 7+ years of relevant legal experience in a corporate legal department or law firm providing legal counsel to health care clients
• Familiarity with FDA regulations related to medical devices.

Our Base Pay Range for this position

$122,800 - $204,600
