Job Description

We are seeking a dynamic, commercially minded and highly motivated team player to provide legal support and advice on a broad array of marketing initiatives and advertising-related activities on a global scale, serving as a critical business partner to enable growth across all Company divisions and locations. This role will be critical in evaluating issues related to marketing, advertising, and social media, and will have responsibility for overseeing the legal review of the Company’s global advertising claims and campaigns, including all publications, on-line content, and contests. This role will also support advertising disputes and will drive the activities and agenda of the Advertising Review Council.

The position will report to and work closely with the General Counsel (“GC”), will partner with legal team members, global marketing and sales teams, and will regularly interface with senior management and outside legal counsel. The individual will partner closely with a Staff Attorney and a marketing paralegal.

The position requires a law degree with and at least three years of relevant experience practicing law in a private firm and/or in-house setting. A successful candidate will demonstrate practical judgment, the ability to render pragmatic advice, a business mindset and commercial acumen, creative problem-solving abilities, excellent writing and communication skills, social intelligence, a proven ability to foster positive client relationships, a strong work ethic, and a rigorous commitment to the ethical practice of law. Specific functions are outlined below.

Job Responsibilities

  • Supervise the interface between Legal, Marketing and product development teams in the development and substantiation of advertising claims and marketing assets, including attending claims meeting and oversight of claims matrices;
  • Perform legal review and provide timely advice and practical guidance regarding claim substantiation strategies and the test processes and data required to support claims in all promotional and advertisement copy;
  • Supervise and improve processes to optimize efficiency and quality control while reducing legal risk related to marketing communications worldwide;
  • Manage the process for guiding marketers in the development of specific claim language including the development of appropriate disclaimers. Work with marketing and advertising teams and outside agencies to review and provide legal input and approval for scripts and content for television, on-line and social media, BISSELL website content, bloggers, influencers, contests, sweepstakes, and other media advertising assets;
  • Develop and/or demonstrate subject matter expertise in all areas of advertising law and understand variances in legal standards for advertising claims within key jurisdictions in which the Company markets products.
  • Exercise mature judgment in identifying questions and issues that should be elevated to the VPGC for attention;
  • Support the GC in managing disputes and litigation associated with advertising and marketing issues, including National Advertising Division (“NAD”) challenges and Lanham Act cases and similar challenges in non-U.S. jurisdictions. Stay aware of legal trends associated with advertising and marketing issues, review and report on relevant NAD, Federal Trade Commission, and other case decisions, and assist with document retention and litigation preparedness activities relative to potential advertising/marketing disputes.
  • Develop training materials and prepare presentations used to educate and train the Global Marketing function on legal process, compliance and risk associated with advertising claims, various marketing initiatives such as PII collection, sweepstakes, contests, and influencers, and other relevant topics.

  • REQUIRED EXPERIENCE/EDUCATION: The candidate must have or must readily qualify for a license to serve as in-house counsel in Michigan or Illinois.

  • Degree minimum: Bachelor’s degree and Juris Doctorate degree from an ABA-accredited law school.

  • Experience level: 3+ years of full-time practice including experience in evaluating advertising claims, responding to advertising disputes, and advising clients regarding privacy and data-management compliance.

  • 3+ years of full-time legal experience with a reputable law firm or in-house legal department.

  • Sound business judgment, clear analytical thinking ability, and the ability to develop and implement practical and creative legal solutions.

  • Excellent situational leadership and interpersonal abilities including the ability to communicate effectively and work with all levels of management.

  • Exceptional listening skills and oral and written communication skills, and the ability to prioritize and manage a large volume of concurrent projects, are essential.

  • PREFERRED EXPERIENCE/EDUCATION: Applicable specialized legal experience with a top-tier law firm or in-house corporate legal staff.
