Job Summary

General Summary:

Qualcomm Incorporated is seeking an experienced export and trade attorney with 10+ years of experience advising on export and trade controls, as well as on EAR, ITAR, and OFAC matters. The individual selected for this role will report to the Chief Risk and Compliance Officer (CRCO) and must be able to execute the below duties and responsibilities.

This is a hybrid position based in either the Washington, DC or San Diego, CA area.

Principal Duties And Responsibilities
• Advise company management of legal, regulatory, and operational risk areas relating to export controls and trade regulations and appropriate means of addressing and mitigating them.
• Advise on implementation of screening protocols to ensure that prohibited financial or commercial transactions not occur, in accordance with OFAC regulatory sanctions against targeted countries, entities, groups, and individuals.
• Conduct OFAC sanctions transactional due diligence, screening, investigations, audits, and risk assessments.
• Advise on and implement protocols to ensure compliance with export screening lists maintained by regulatory agencies such as BIS, Department of Commerce; DDTC, Department of State; and OFAC, Department of the Treasury.
• Research and analyze export, trade, and customs legislation, regulations, guidance, and sanctions.
• Interact with local, state, and federal law enforcement where appropriate.
• Coordinate collaboratively and effectively across company functions.
• Track and appropriately document developments and report same to the CRCO and stakeholders.
• Communicate, where appropriate, to large groups and multiple constituencies, including training and guidance to the business.
• Provide legal guidance for the Export Control team, which is part of Government Affairs. This may include screening and analyzing export classifications, drafting and implementing appropriate policies and processes, and training company employees.
• Manage and conduct internal export and trade-related compliance investigations and provide legal support for any government-initiated audits and inquiries relating to export and trade.
• Ensure that any substantiated investigations result in remediations that maintain a culture of compliance.
• Assist in resolving trade-related contract issues with vendors, clients, customers, and other third parties.
• Manage the engagement of outside counsel, including monitoring budget and spend.
• Maintain confidentiality, brief stakeholders on a need-to-know basis as determined by the sensitivity of the issue, and demonstrate trustworthiness with highly sensitive information.
• Analyze and provide counsel on legislation and policy affecting the company’s interests
• Provide proactive counsel and guidance on international trade law, regulation and policy matters for the company.
• Develop a close rapport with internal stakeholders to understand supply-chain risks and opportunities to build new processes. Advise on value chain resiliency issues.
• Help assess the impact of potential executive orders and legislation that could restrict exports, foreign investments, or other foreign activities, and/or disrupt relevant supply chains. This work may include, for example, legislative analysis and drafting (informed by close consultation with different internal stakeholders) and engagement with the Hill and other parts of the United States Government.

Minimum Qualifications
• Juris Doctorate degree or international equivalent.
• Twelve (12) years of relevant experience as counsel in the government, with at least 6 years of large law firm experience.
• Ten (10) years of legal experience advising on global trade regulations, including U.S. export controls, sanctions, and customs regulations.
• Six (6) years of leadership experience.
• Active bar license to practice law in the state or jurisdiction where the employee will be practicing (or ability to obtain upon hiring).

Preferred Qualifications
• Fifteen (15) to 20 years of relevant experience as counsel in the government, with at least 6 years of large law firm experience.
• Ability to effectively collaborate with teams.
• Ability to communicate effectively in writing and verbally.
• Strong analytical and problem-solving ability.
• Experience engaging with governmental (regulatory and enforcement) agencies.

This also includes the ability to get things done with fewer resources and in less time, work on multiple tasks at once without losing track, and foresee and plan around obstacles.

Technical Knowledge: Knowledge of program management methodology (e.g., planning, scheduling, tracking, execution). This includes the ability to effectively use program management tools to carry out the program management function.
