Our Entertainment and Media Attorney reports to the General Counsel and is responsible for providing legal advice and counsel to the Executive Leadership of EMF Broadcasting and its affiliates. This position will handle a broad range of entertainment and media matters, from financing, production, licensing, and distribution of media to strategic guidance on industry regulations relevant to film and publishing. You’ll also support radio, podcasting, streaming, live events and other media ventures as needed. Clear and timely communication, high level of initiative, and close partnership with the General Counsel, Senior Leadership, and outside counsel are essential to success in this role. Effectiveness will be measured in your ability to successfully apply legal expertise and insights to projects and the management of relationships, both internally and externally. Understanding and daily application of ministry values, mission, and biblical principles is key to being successful in this position.

Job Responsibilities

  • Research, understand, and recommend legal approaches based on the ministry’s interests and legal, compliance, and ethical principles.
  • Partner with Chief Legal Officer to assess and manage areas that pose risk to the ministry.
  • Establish and maintain solid relationships with business unit owners and outside legal counsel.
  • Analyze and communicate complex legal issues and make recommendations to decision-makers.
  • Draft and review various agreements in all areas of entertainment, including film, music, television, radio, theater, multimedia, publishing, and visual arts.
  • Manage intellectual property rights and oversee trademark and title clearance requests.
  • Negotiate terms of transactions and clearances for entertainment releases as well as advertising, marketing, and creative services.
  • Review and negotiate applicable agreements, including but not limited to music licensing, talent, agency, distribution, merchandising, and marketing agreements.
  • Maintain relationships with studios, artists, and/or producers and remain aware of industry trends.
  • Monitor and report on changes in FCC initiatives and their impact on American consumers and the telecommunications Industry.
  • Keep abreast of and report on developments affecting the telecommunications industry and consumers by reviewing court and commission decisions.
  • Monitor and report on EMF’s compliance with pertinent rules, laws, and regulations.
  • Perform, at the request of the Chief Legal Officer, legal audits and recommend procedures and policies to mitigate risks.
  • Keep the Chief Legal Officer informed of all legal activities and developments.
  • Provide a positive, professional influence throughout the ministry; maintaining a harmonious work environment within your office and with those with whom you work.

Requirements / Qualifications

  • A member in good standing with the Tennessee State Bar Association or another State Bar Association.

  • Maintain good standing in the bar association(s) where active membership is held.

  • Minimum of seven (7) years of experience as an attorney in a firm, corporate legal department or equivalent setting; experience in the practice of general corporate and media business transactions.

  • Must possess sound judgment regarding appropriate risk tolerance while effectively communicating risks to key stakeholders to drive expedient, thoroughly informed decisions.

  • Excellent communication, negotiation, and interpersonal skills. Ability to build trust and value others; communicate effectively; and collaborate with others.

  • High level of integrity; demonstrated ability to work independently; establishing and meeting performance/ministry goals.

  • A collaborative and flexible style, with strong service mentality. Need to be seen as a team player.

  • Excellent interpersonal skills with the ability to develop sincere business/ministry relationships.

  • Demonstrated commitment to the social sector with a passion for our mission and values.

  • Understanding of the film, publication, and radio broadcast industries in non-profit sector.

  • Understanding of non-profit organizations and familiarity with structuring joint ventures.

  • Experience in Intellectual property, Media law, FCC laws, and litigation.

  • Familiarity with content agreement negotiating (including, by way of example only, audiovisual programming, licensing, and production agreements) and intellectual property law (copyright, trademark, rights of publicity).

  • Familiarity with the entertainment, broadcast/cable, Internet, mobile, other digital (including social) media businesses.

  • Familiarity with audiovisual production legal work, including licensing of audiovisual content and data components.

  • Working knowledge of media policy, law, and regulation, including familiarity with the Federal Communications Commission and its initiatives and approach to regulating broadcasters.

  • Experience supervising paralegal/legal support staff.
