THIS IS A T32 EXCEPTED SERVICE, INDEFINITE POSITION

Selectee may be non-competitively converted to permanent status if/when funding becomes available or position becomes unencumbered.

The primary purpose of the ATTORNEY-ADVISOR (GENERAL), GS-0905-13, is to serve as the full-time professional legal adviser and support to the Adjutant General, the Commander of federally recognized Army and Air National Guards, and state/territory unique public defense or safety structures. Also serves as the principle professional legal adviser to the United States Property and Fiscal Officer (USPFO), state/territory National Guard senior leadership, state/territory National Guard directorates, and subordinate National Guard commanded units or state/territory level divisions.

May make additional selections within 90 days of eligible(s) issuance.

Conditions of Employment

CALIFORNIA NATIONAL GUARD MEMBERSHIP IS REQUIRED: This is an excepted service position that requires membership in the California National Guard. Selectee will be required to wear the military uniform. Acceptance of an excepted service position constitutes concurrence with these requirements as a condition of employment. Compatible Military Assignment and Grade are required. Military technicians must be assigned to a military position in the same unit which they are employed or, in a unit that is supported by the employing activity. Military technicians must hold the military grade specified for the position.

Priority Areas(s) of Consideration:
Priority consideration is first given to the areas below.

AREA I= Current California National Guard employees who are serving on a Permanent/Indefinite/Temporary appointment.
AREA II= Current California National Guard members.
AREA III= Current military members of the Air Force/Army National Guard, Air Force/Army Reserve or Air Force/Army Active Duty. (Applicants who are currently in other Air/Army branches and NOT currently a member of the California National Guard (CNG) must become a member of a compatible unit of assignment within the Army CNG commensurate with the military grade listed in this announcement prior to federal assignment).

Military Grades: O-3 through O-4

Recruitment/Relocation
Recruitment/Relocation Incentive MAY BE authorized, subject to funding and approval.

PCS
Relocation Costs MAY BE authorized subject to provisions of the Joint Travel Regulation, funding, and an agency determination that a Permanent Change of Station (PCS) move is in the Government's best interest.

Must maintain appropriate level of security clearance.
Must wear appropriate military uniform including required grooming standards.
Must maintain a compatible military unit, grade and job assignment as required by current directives.
Participation in direct deposit is mandatory.

Qualifications

General Experience: Experience in collecting and analyzing data effectively, efficiently, and accurately; Knowledgeable of military and civilian laws, directives, regulations, policies, and procedures; Ability to clearly enunciate English without impediment of speech that would interfere or prohibit effective communications; Experience in interpersonal communications, empathy, and effective listening; Ability to write English in reports and presentation formats; Ability to communicate -orally and in writing- clearly and effectively; Ability to organize thoughts, research materials, and manage case projects; Skilled in comprehending and interpreting directives and laws.

ATTORNEY-ADVISOR (GENERAL), GS-0905-13: Must have at least 24 months experience of the Army National Guard mission requirements and Air National Guard mission requirements and work experience as a professional Attorney Advisor; Competent in providing legal interpretation and guidance to managers and senior leaders on Title 32 § 709, United States Code, National Guard Program. Able to recognize and identify complex constitutional, state-federal, and military-civilian jurisidictional issues frequently associated with the organization and administration of the Title 32 National Guard, and articulate them in the appropriate forum or context; Competent in providing legal interpretation and guidance to managers and senior leaders on 10 United States Code, and the state equivalent to the federal Uniform Code of Military Justice; Conducting legal research in connection with cases pending administrative hearings, trials before courts of original jurisdiction, or arguments in appellate courts; Addressing legal questions referred by administrative officials of the employing agency, such as questions concerning the interpretation and application of statutes, rules, and regulations as they pertain to contracts, claims, or other legal instruments involving private business, state, local, national, or foreign governments; Addressing questions regarding the effects of provisions of proposed legislation or proposed changes in agency policies or regulations; Researching and providing legal advice in functional areas of Administrative, Labor, Medical and Physical Disability, and Ethics Law; Capable of providing legal assistance in accordance with prescribed instructions and within legal guidelines; Planning, coordinating, and formulating litigation strategies; Addressing complex and difficult legal questions and factual issues requiring extensive research, analysis and evaluation of available precedents; Dealing with issues in the functional areas and demonstrated abilities to quickly identify both the legal and judgmental issues; As a subject matter expert, experienced in determining the facts and recommending effective solutions with minimal guidance or supervision; Developing and providing solutions to conflicting or contradict-tory DoD regulations, directives, and policies, and other NGB or state 881legal guidance; Addressing and resolving complex and difficult legal case problems, legal questions, or issues involved in the drafting of interpretation or application of legislation, regulations, contracts, decisions, or opinions requiring a solution; In preparing memoranda of reports that outlined and analyzed the factual and legal issues; Preparing legal documents or advisory opinions, participated in contract negations, and examined documents for legal sufficiency.

Education

Must have a Bachelor of Laws or Juris Doctor degree in law issued by an an ABA- accredited law school; and, admitted to practice law in the highest court of any U.S. state, commonwealth, territory or the District of Columbia.

Completed the 14-week Judge Advocate General Basic Course.
