Los Alamos National Laboratory has an exciting opportunity for an experienced environmental attorney to provide legal advice and counsel on a wide range of environmental compliance, litigation and related matters. Reporting to the Associate General Counsel for Environment, Safety and Health in the Laboratory’s Office of General Counsel (OGC).
A successful candidate must also have significant experience and expertise in environmental law and have the ability to apply their expertise to resolve complex environmental issues in creative and effective ways. You will have a lead role in advocating for and/or negotiating legal positions on significant environmental matters, and are expected to be able to work independently with minimal supervision .
As part of an organization responsible for all Laboratory legal affairs, the selected candidate must be able to work cooperatively within a multi-disciplined legal organization, across business functions, and with various stakeholders.
Location: This position will be physically located in Los Alamos.

Clearance: Q (Position will be cleared to this level). Applicants selected will be subject to a Federal background investigation and must meet eligibility requirements* for access to classified matter. This position requires a Q clearance which requires US Citizenship except in extremely rare circumstances. Dependent upon position, additional authorization to access nuclear weapons information may be required that may or may not be available to dual citizens depending upon the circumstances.
- Eligibility requirements: To obtain a clearance, an individual must be at least 18 years of age; U.S. citizenship is required except in very limited circumstances. See DOE Order 472.2 for additional information.
New-Employment Drug Test: The Laboratory requires successful applicants to complete a new-employment drug test and maintains a substance abuse policy that includes random drug testing.
Regular position: Term status Laboratory employees applying for regular-status positions are converted to regular status.

- Provide legal advice and counsel to Laboratory management and employees on environmental law matters, including compliance, permitting, enforcement actions and litigation matters.
- Draft and/or review of legal documents, including regulatory deliverables, permit requirements, policies, rulemakings, and responses to enforcement actions and other court actions.
- Conduct and participate in negotiations with federal or state governments and citizens groups in an effort to settle or resolve matters in the Laboratory’s best interests (e.g., enforcement actions, permits, citizen suits).
- Represent the Laboratory in administrative permit or rulemaking hearings, enforcement actions, appeals and other legal proceedings, managing and working with outside counsel, as appropriate.
- Identify and implement strategies in support of OGC’s focus on preventive law, proactively working to minimize legal risk to the Laboratory.
Requirements / Qualifications
You will need to have broad, substantive knowledge and advanced experience in environmental law, including in one or more of the major federal or state environmental laws. You will also need the ability to work independently applying experience and expertise to solve a wide‐range of environmental issues.
We are looking for someone with the ability to interact with all levels of staff and management, establishing productive working relationships, and providing constructive advice on a variety of environmental issues. You will also need to be able to work collaboratively in a team environment.
We need you to have experience conducting negotiations concerning environmental matters and demonstrated success in reaching settlement or resolution.
You will need significant experience with environmental regulatory authorities at the federal, state or tribal level.
You will need the ability to work with legal research tools (e.g., Westlaw, Lexus), with legal matter management and document systems such as eCounsel and M-Files, and with litigation databases (e.g., Relativity).
You will need knowledge of the rules governing the practice of law and the ability to recognize and resolve ethical issues.
Position requires a Juris Doctorate Degree from an American Bar Association (ABA) accredited law school and an active Bar membership in good standing (any jurisdiction) and 7 years of legal experience after passing the Bar and being admitted to practice. Preference will be given to those who have devoted the majority of their practice to environmental law.
It would be a plus if you had administrative litigation or other litigation experience, including administrative hearings and enforcement proceedings. Additionally, i t would be beneficial if you were well versed in court and administrative procedural requirements and rules of procedure applicable to the environmental area.
Experience working with the Resource Conservation and Recovery Act (RCRA) or comparable state statute is desired. Advanced experience with RCRA permits for treatment and storage of hazardous waste, and associated permit renewals and amendments, including permit appeals processes at state and federal level is a plus, as is experience with RCRA generator requirements. We will, however, consider applicants with primary environmental experience in other areas.
